USE OF OUR SERVICES IMPLIES ACCEPTING THE FOLLOWING TERMS AND CONDITIONS.

A. Introduction:

Paris On the Way is a company subject to French law, with a capital of 15 000€, whose headquarters are at 13 rue Beudant, 75017 Paris, France. The company is registered under the Siret number 519 551 766 00016.
Paris On the Way (POW) offers guided tours, themed lectures, museum reservations, and access to exclusive guided tours, as well as consulting for recreational and business tourism, creating new tours, and connecting with professionals in the transport, lodging, and restaurant industries.

B. Purpose:

The purpose of these terms and conditions is to set out the terms and conditions granting access to the products and services offered by Paris On the Way. Consequently, any order made by the Client implies the unreserved agreement and full acceptance of these general terms and conditions, which take precedence over any other document, except under conditions expressly agreed to in writing by the Vendor.
The present terms and conditions are subject to French law and are effective as of 1 January 2013. They may be modified by POW at any time without prior notice. Should a new version of these terms and conditions be published, these latter shall not apply to bookings previously accepted and confirmed by POW. The applicable terms and conditions of a booking are those present on the website at the time of the booking. Any dispute arising from these terms and conditions which was not able to be resolved amicably between the parties shall fall under the jurisdiction of the city of Paris. Should a conflict arise concerning these terms and conditions, the French version shall prevail over any translated version.

C. Prices:

All prices in the promotional brochures and on the website www.parisontheway.fr are indicated in Euros and inclusive of all taxes. They may be subject to revision at any time. Similarly, any price quoted prior to booking is subject to change. Applicable prices are those indicated on the POW website on the day of the firm and definitive booking.

Monday to Friday straight through from 9 a.m. to 7:30 p.m. and on Saturday from 9:30 a.m. to noon. On the web at www.parisontheway.fr

- Any disability needing special assistance must be reported at the time the reservation is made in order to determine the practical arrangements required. A request will then be issued to the Site so as to ensure the possibility of the visit. In the event that access to the Site should prove impossible due to a lack of necessary infrastructure at the Site, POW shall not be held liable in any way.

E. Conditions of the visits:

Number of pax: We recommend a maximum of 30-35 individuals per Guide Interpreter (equipped with headphones), beyond which a second guide will be required. Some museums and monuments limit the number of people per guide to 25. Museums and monuments require group reservations for parties of 5 people or more. If a reservation with the Site is not obtained, the POW visit will not be able to take place.

Client delays: The Guide will automatically wait for the Client for one hour following the meeting time fixed at the time the booking was made. In this case, the visit will be cut short for the amount of time of the delay, or, subject to the availability of the Guide and the consent of POW, may be extended for the same amount of time. The service will then incur a proportionate surcharge based on the applicable rates, and only if POW grants its consent to the Guide on site.

Guide delays: The Client will wait for the Guide for one half-hour. Subject to the availability of the Guide, the visit may be extended for the amount of time of the delay. In the event of a disagreement, the visit will be cut short for the amount of time of this delay and will lead to a proportionate reduction for the Client based on the applicable rates. Beyond a half-hour delay, the group has the right to cancel the visit and claim damages that shall not exceed the total price of the visit initially set.
The visits are available to individuals, grouped individuals, and pre-existing groups. The duration of the visits is that featured in the promotional brochures and on the website www.parisontheway.fr.

Site availability: Visits take place during Site opening hours, excluding exceptional closing times. In the event of unforeseeable circumstances affecting the proper functioning of the Site, involving security, technical or artistic constraints, the course of the visit may be modified the same day, with no possibility of refunds or restitutions on behalf of POW.

To book your Guide and your visit, you will be required to send us a request in writing, and to pay the full amount of the service beforehand. Visits will not be confirmed if the full payment is not received.
Ancillary services of any kind whatsoever are provided by licensed professional companies that are authorized to carry out these kinds of services and are insured to cover any accident that may occur during the duration of the services offered. Paris On the Way cannot be held liable for any accident or damage that occurs during a visit organized by our agency when we are only acting as an intermediary between these service providers and the Client.

F. Refunds and cancellations:

Some activities are subject to weather conditions and may be cancelled if conditions are unsuitable. However, all services are subject to cancellation when circumstances arise that are beyond the control of POW or of its service providers. In cases of force majeure or events that may threaten the security or disrupt the proper running of the service, bookings may be postponed or cancelled. POW will then provide a counter-offer for the service.

If a service that you have booked is cancelled, or if its date, time or location is modified, you accept that POW may use the contact details that you provided when making the booking in order to keep you informed of the procedure to be followed. Client cancellations: Any cancellation for whatever reason on your part must be made in writing to Paris On the Way. The cancellation request is effective only as of when the POW team has been informed of it. Vouchers provided by POW may not be returned, exchanged or resold.

Cancellation fees in case of Client withdrawal or no-show:

  • More than 30 days prior to the service: 90 % refunded
  • 30 - 15 days prior to the service: 50 % refunded
  • 15 - 7 days prior to the service: 25% refunded
  • Fewer than 7 days prior to the service: 0% refunded

 

G. Force majeure:

Force majeure or cas fortuit refers to any extraordinary event, unforeseeable and unavoidable as defined in Article 1148 of France’s Civil Code, beyond the reasonable control of POW, which hinders the carrying out of services sold, preventing the agency or the service providers involved in the fulfillment of the visit to carry out all or part of the obligations set out in the present contract.

It is expressly agreed that this can include extreme weather events, strikes in transportation systems, museums and monuments, hotel personnel, or air traffic controllers, the interruption of telecommunication networks and of the Internet, breakdown of equipment provided by the service, political instability or riots, and any restrictions set out by the government or public authorities.
The party invoking an instance of force majeure shall immediately notify the other party of the beginning, duration, and end of this event, failing which it shall not be cleared of responsibility.

Additionally, each party will be responsible for any cost incurred as a result of force majeure: consequently, the Client will be solely responsible for any additional costs that they may incur by continuing their visit after the force majeure has occurred, such as the purchase of more expensive excursions, delays, or unforeseen lodging requirements.

H. Right of withdrawal:

In accordance with Article L. 121-20-4 of France's Consumer Code, the provision of accommodation, transportation, catering or leisure services that must be provided on a given date or according to a specific periodicity are not subject to the right of withdrawal.

I. Illustrations on the website:

All photos that appear on the website are non-contractual. POW does not assume any liability for the accuracy of any information provided on the website. Documents containing descriptions, technical details (in particular times, dates, and duration), photos, illustrations or any other information, are provided merely as an indication.

J. Personal data:

In accordance with the Data Protection Act of 6 January 1978, the information requested on the contact and quote forms is necessary to process your request. POW values the privacy of the Client and the protection of information provided by the Client to POW, and adheres to current legislation concerning the protection of personal data. You have a right to access, correct, or remove data relating to you by contacting Paris On the Way, 13 rue Beudant, 75017, Paris, France, and attaching a copy of your photo ID to your request.

POW may provide the Client with information enabling a better understanding of the offers presented. Finally, provided it has obtained consent beforehand, POW may transfer data concerning the Client to third parties that may include its Partners. Like most websites, POW uses cookies, alphanumeric identifiers that are sent to your computer’s hard drive via your web browser. Cookies allow POW to recognize the Client’s web browser and offer him or her personalized services that may be of interest.
Every time the Client connects to the site, POW receives and records certain kinds of information. However, the Client may refuse cookies. Web browsers provide instructions on how to refuse and disable new cookies.

K. Responsibilities:

The liability of each of the parties is limited to the commitments undertaken by them within the terms of the contract. Neither party shall be held liable for non-performance or delays in performance of its obligations set out in these terms and conditions if the non-performance or delay is the result of an instance of force majeure. POW shall not be held responsible in the event of the following:

  • Theft, loss of funds and stocks belonging to the Client or to participants, which occurred during the events covered by the contract,
  • Personal injuries and damage to property suffered by the Client or by participants during the intervention of one or more service providers under the terms of the contract,
  • Assault or deliberate injury that the Client or participants may inflict on themselves or others during a fight or accident resulting from a state of marked inebriation or the taking of narcotics,
  • Direct or indirect damage of any kind whatsoever that may affect objects or material deposited by the Client or by participants during the events covered by the contract,
  • Direct or indirect damage of any kind whatsoever that the Client or the participants may cause to one or several service providers or their agents under the terms of the contract,
  • Degradation caused by the Client or participants to any material, equipment and/or premises of one or several service providers under the terms of the contract.

L. Glossary

POW: Paris On the Way (the Vendor)
Client: the natural person or legal entity who purchases a service, with the understanding that the Client might or might not be the Recipient of the Service, depending on whether the Client will use the Service personally or professionally.
Recipient: the person who uses the Service. Service: the event or performance provided by the Partner to the Recipient.
Partner: the service provider selected by POW that provides the Service to the Recipient Pass: the voucher issued to the Client by email or by post once the Client has confirmed a booking. To be presented by the Client on the day of the Service.
Tickets: the tickets to be presented to the Partners (Museums, Monuments...).
Prepaid: a Service paid for ahead of time by the Client to POW.
Pre-booking: It is possible to make a pre-booking. If a firm and definite booking has not been made by the end of the pre-booking expiry date, it will automatically be cancelled.
Voucher: a voucher from a professional in the tourism industry accepted by POW following an agreement/contract between the two parties.
